Thomas W. Newton

Mr. Newton has practiced law for almost four decades, focusing on construction litigation and transactional work. After admission to the California Bar in 1984, he joined Anderson, McPharlin & Conners as a litigator representing sureties in construction bond matters and design professionals in errors & omissions disputes. He gained valuable experience in the areas of mechanic’s lien law and related non-payment remedies, construction contract interpretation and enforcement, and the standards of care applicable to various actors in the construction and development field.

In 1986, Mr. Newton co-founded the firm Tims & Newton, where he continued as a construction litigator. At Tims & Newton he broadened his scope of services, to include business entity formation, corporate governance, and construction transactional work. While there, he developed expertise in litigation involving geotechnical engineering and expanded the firm’s practice to include construction defect litigation. Following the death of Mr. Tims, he operated Tims & Newton as a sole practitioner. Mr. Newton again expanded his scope, to include real estate transactional and litigation services.

In 2006, Mr. Newton joined the board of directors of Aircraft X-Ray Laboratories, Inc. In 2010 he joined Aircraft X-Ray full time as chief legal and chief operating officer. While there, he participated in NADCAP, an international accrediting board for the aerospace industry. In 2014 he was appointed as Chair of the NADCAP Supplier Support Committee and as a member of the NADCAP Management Council.

In 2015 he returned to the full-time practice of law, continuing to serve the construction and real estate industries in both transactional and litigation roles. Since May of 2021 he has worked exclusively with Pierce, Kavcioglu, Espinosa and Cesar.

Representative Matters

  • Managed construction take-over of Fire Station at Norton AFB, on behalf of performance bond surety following general contractor default.

  • Represented commercial building owner in litigation against demolition contractor for botched asbestos removal, verdict for client at trial.

  • Represented construction manager in breach of contract action brought by sub-contractor, resulting in no-payment dismissal with prejudice.

  • Represented residential owner in litigation over landslide, gaining favorable settlement funded by insurance carriers.

  • Conducted various contract reviews for general building/engineering contractor, negotiating significant revisions with owners’ representatives, reducing client’s potential exposure to claims.

  • Represented concrete subcontractor in construction defect litigation brought by condominium HOA, obtaining a nuisance value settlement during mediation.

  • Represented pub/restaurant owner in two lawsuits brought by Unruh Civil Rights Act “serial plaintiffs.” Obtained a nuisance value settlement in one case and a no-payment dismissal with prejudice in the second.

  • Represented dewatering subcontractor sued in multi-plaintiff soils subsidence case with multi-million dollar demands.  Obtained dismissal with prejudice for client the day before trial for $12.00.
