Jennifer Tung

Jennifer Tung is an experienced construction litigator that has represented owners, developers, general contractors, and subcontractors alike on both private and public works projects. She has successfully litigated, arbitrated, and mediated matters related to scope of work disputes, claims for additional time and payment, mechanics liens, bid protests, and claims of construction defects and delays. Ms. Tung is also experienced in reviewing and drafting construction agreements. She advises clients both before and during a construction project, with the goal of managing risk and reducing the potential for future litigation. 

An emerging thought-leader on the topic of green and sustainable construction, Ms. Tung frequently writes and presents on this subject.

Representative Matters

  • Successfully eliminated over $10M in consequential damages, through targeted law and motion practice, sought by a developer-owner against a general contractor for the contractor's alleged breach of contract and failure to timely complete a project.

  • Helped to obtain a $15M settlement on behalf of a general contractor against a local public agency that had terminated the contractor for purportedly falling behind schedule on a $37M construction project. This matter settled one week into a four-week arbitration.

  • Successfully pursued over $1M in indemnity payments on behalf of a public agency against a project's engineer and design team.

  • Defeated lawsuit alleging breach of contract and violation of restrictive covenant through successful motion for summary judgment.
